1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of OrbitsTrek, a cloud-based business management platform covering attendance, payroll, HR, warranty and service management, and lead management (the "Service"), operated by OrbitsTrek ("we", "us", or "our"). By creating an account, starting a trial, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We may suspend or terminate access to protect the Service, other customers, or to comply with the law.

3. Subscriptions, Trials, and Payment

Paid modules are billed according to the pricing and billing cycle selected at checkout or agreed with our team. Trials, where offered, provide temporary access to selected modules and expire automatically unless converted to a paid subscription. Fees are non-refundable except where required by law or expressly stated otherwise in a separate written agreement.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
• Use the Service to store or transmit malicious code or infringing content.

5. Your Data

You retain all rights to the data you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and consents to submit Customer Data, including any personal data of your employees or customers. 6. Intellectual Property

The Service, including its software, design, and branding, is owned by OrbitsTrek and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as necessary to use the Service as intended.

7. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to the Service from time to time, and will make reasonable efforts to minimize disruption.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms and fail to remedy the breach within a reasonable period after notice, or immediately in cases of serious misuse. Upon termination, your right to use the Service ends, though certain provisions of these Terms will survive.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. To the fullest extent permitted by applicable law, OrbitsTrek shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
